1. Object of the Service Funeral Plan Spain is a legally constituted commercial company that provides comprehensive funeral services, covering all necessary aspects to support families during the difficult time of a loved one’s passing. This includes, but is not limited to, transfer, preparation, viewing (wake), ceremony, cremation, and burial/interment of the deceased, as well as other necessary or complementary services in the funeral process. Our mission is to offer a professional, respectful service tailored to the needs of families, always ensuring the highest quality, flexibility, and personalized attention. To this end, we have highly trained staff and a network of collaborators/partners ensuring excellence in service delivery.

2. Nature of the Contract The contract established between the client and Funeral Plan Spain is in the nature of a contract for the future provision of funeral services. This contract is not considered death insurance nor does it constitute an insurance premium. The financial consideration provided by the client represents the price of the funeral services that Funeral Plan Spain commits to perform in the future, either directly or through its collaborators/partners and within the scope of its corporate purpose. This commitment includes ensuring that all contracted services are provided under the conditions and with the quality previously agreed upon, except in exceptional circumstances detailed in the corresponding clauses.

3. Included Services The available funeral services are organized into plans designed to adapt to the diverse needs of families. These plans are described in detail in the corresponding annexes and include the following main categories:

  • Funeral Plan Spain Simple: This plan includes basic services such as transfer, cremation, and urn, providing an essential yet dignified solution for saying goodbye to a loved one.
  • Funeral Plan Spain Standard: Includes all services from the Simple plan, plus viewing/wake facilities, preparation, and hearse, offering a higher level of customization and comfort.
  • Funeral Plan Spain Premium: This plan adds additional services like floral decoration, invitations, and obituaries/death notices, providing a more personalized and solemn experience.
  • Funeral Plan Spain Repatriation: Specifically designed to guarantee the international transfer of the deceased’s remains, includes additional services such as embalming and consular procedures, ensuring all formalities are managed efficiently.

The complete specifications, prices, payment methods, and customization options are detailed in the annexes attached to the contract. Additionally, clients can consult directly with Funeral Plan Spain to further customize their plan and adapt it to specific requirements.

4. Service Modifications Funeral Plan Spain reserves the right to substitute contracted products or services in exceptional cases, such as discontinuation, impossibility of manufacture, or technical reasons beyond its control. In all cases, a replacement of equivalent characteristics and quality will be guaranteed. The client will be informed in a timely manner about any changes and, if necessary, may opt for adjustments to their contract without compromising the quality of the contracted funeral service.

5. Territorial Scope The contracted funeral service is valid throughout Spanish territory, including the peninsula, the Canary Islands, and the Balearic Islands, with specific exceptions for certain smaller islands (Formentera, Cabrera, Conejera, Hierro, and La Graciosa). Funeral services will be performed in facilities agreed upon with Funeral Plan Spain, seeking to minimize travel from the contractor’s domicile and always ensuring the greatest comfort for the families.

6. Beneficiaries The contract holder may designate up to four beneficiaries for the funeral service, and must specify their personal details at the time of contracting. Only one of them will receive the contracted service. The client may modify the beneficiaries within a period of two years from the signing of the contract, subject to prior notification to Funeral Plan Spain. Modifications after this period may be subject to additional conditions, which will be clearly specified by Funeral Plan Spain. The contractor is also responsible for informing the beneficiaries about the contracted services and ensuring that Funeral Plan Spain receives timely notification in the event of death. Furthermore, they must facilitate the necessary communication so that the funeral service can be provided in a timely and proper manner.

7. Price and Payment Methods The price of the funeral service is clearly specified in the annexes. There are two payment methods:

  • Single payment: Payment of the total amount within a maximum period of seven days from the formalization of the contract. This method ensures that the services will be fully available without the need for additional procedures.
  • Deferred payment: According to the conditions detailed in the annexes, with financing options over five or ten years. In the event of death before completing the payments, the outstanding balance must be settled before the provision of the service, thus ensuring that the service can be carried out without interruption.

8. Communications All communications between Funeral Plan Spain and the client must be made through the designated official channels. It is the client’s responsibility to keep their contact information updated to ensure that all notifications can be received on time. The main channels are:

  • Funeral Plan Spain: Contact telephone number and address available on the official website.
  • Client: Any change of address or relevant information must be reliably notified to Funeral Plan Spain.

9. Confidentiality and Personal Data Funeral Plan Spain guarantees the processing of the client’s and beneficiaries’ personal data in accordance with current data protection regulations. The data will be used solely for the management of the contracted services and will not be shared with third parties except where strictly necessary for the provision of the service. 10. Applicable Law and Jurisdiction This contract is governed by current Spanish legislation. Any dispute arising from the interpretation or execution of the contract shall be resolved by the Courts and Tribunals of Madrid, with the parties expressly waiving any other jurisdiction that might correspond to them.

11. Periodic Review of Conditions These general conditions are subject to periodic updates to ensure transparency and adaptation to legal or commercial changes. The client is recommended to review the most recent version available on our website before contracting or renewing services.

12. Annexes and Supplementary Documentation Specific details about the contracted services, including prices, payment terms, and additional conditions, are set out in the annexes which form an integral part of this contract. The annexes also include detailed information on:

  • Services and provisions of each plan.
  • Specific conditions for repatriation.
  • Decoration and customization options.
  • Cancellation and refund policies.

13. Clause for Cremation Services Cremation and viewing/wake services may be carried out up to a maximum distance of 50 km from the place where the deceased is collected. If the client wishes for a specific crematorium in a locality where there is no more than one crematorium, FUNEPLAN may apply a surcharge of €495 plus VAT for the Funeral Plan Spain Basic and €995 plus VAT for the subsequent funeral plans that include viewing/wake.
